Please read the agreement on the rights of using the Transwork Freight Exchange (hereinafter referred to as portal) before using the portal. By pressing ''accept'' and registering, you agree that you commit to this Agreement. If you do not agree with all conditions, and do not accept or do not press the button, the registration process will not continue. This portal is owned by Transwork d.o.o. Banja Luka, and it is strongly forbidden to use it for any purpose unless you accept the conditions and provisions of this agreement on the Rights of the use that is made by a Transwork d.o.o. Banja Luka. If a person intends to use the portal without the written consent of Transwork d.o.o. Banja Luka (signed contracts), Transwork will ask for refunding damage in accordance with local copyright laws and other laws relating to this issue. If the user accepts the terms and provisions of the Agreement on the Rights of Use / sign a contract with Transwork d.o.o. Banja Luka, can access the registration and use one of two different types of license: 1. This license is intended for the companies which provide transportation services that allows user registration, publishing freight and vehicle offers, search offers and access to the data available on the portal, only after submitting the required documentation, user authentication and verification of data accuracy, and verification by the portal administrators. 2. This license is intended for companies that provide vehicles, which allow the user registration, verification, publish vehicle offers, search vehicle offers and access to the data available on the portal. If the portal administrator determines that the documentation provided and the data are not authentic and accurate, the user may be denied access to the portal, i.e., the registration will not be verified. Portal gives user access to customer platform alongside other users without priority over other users. Portal and its source code are protected by copyright. Portal remains the property of Transwork. User of Transwork must report any use of third parties which is contrary to the right of use of this Agreement or the alleged claims of third persons against its use, or against Transwork, to enable the rapid protection of rights. User agrees that Transwork sole purpose to keep information is for process of concluding the contract and for obtaining information about the user credit worthiness from the respective agencies. The user is obliged to inform Transwork of any significant change about company in court registry immediately upon learning of the change. These are especially true of transformation, change of address, and print or write in trade and business register of authorized person representing the company. Transwork takes no responsibility for the accuracy and completeness of the information set by other users or portal compatibility with user computer equipment or connections for data transfer. Transwork is not a contractual partner, or agent in contracts concluded by using the portal. Transwork accordingly does not guarantee the regular functioning of the contractual agreement between the users. The user releases Transwork all liability incurred as a result of the use of portal by the users which are inconsistent with this Agreement. According to a Transwork, Transwork may terminate this contract for not paying fees for portal use. EXCEPT AS EXPRESSLY AUTHORIZED, CUSTOMER SHALL NOT, COPY, IN WHOLE OR PART, PORTAL OR THE DOCUMENTATION, MODIFY PORTAL, PREPARE OF CONCLUDE WHOLE OR ANY PART OF THE PORTAL, OR RENT, DISTRIBUTE, SELL, OR CREATE DERIVATIVE WORKS OF PORTAL. The client accepts that certain aspects of the licensed material, including the specific design and structure of individual programs, constitute trade/business secrets and/or material copyrighted by Transwork. The Client undertakes not to disclose, provide or otherwise make available a trade secret or copyrighted material in any form, to any third party without prior Transwork written consent. The client agrees to implement reasonable security measures to protect their trade secrets and copyrighted material. Title to Portal and documentation shall remain solely with Transwork. LIMITED WARRANTY. Transwork guarantee that the content of portal conforms to the published specification. If any possible changes to the portal, the user will be notified prior to the introduction of changes. Customer's exclusive remedy and the entire liability of Transwork and its suppliers under this limited warranty will be that Transwork or its service centers, repair/solve faults in the functioning of the system/portal, or reimburse the incurred cost of registration, i.e., the monthly fee for using the portal if reported to the party supplying the Portal to Customer. In no event does Transwork warrant that the portal is error free or that client can use the portal without problems or interruptions. This guarantee does not apply if the portal (a) is altered, except by Transwork, (b) is not registered, did not work, or it is not treated in accordance with the instructions provided by Transwork, (c) the subject misuse, neglect or accident, or (d) or used in unauthorized activities. NOTICE: EXCEPT AS SPECIFIED IN THIS WARRANTY, ALL EXPRESS OR IMPLIED CONDITIONS, REPRESENTATION, AND WARRANTIES INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT OF ARISING FROM A COURSE OF DEALING, USAGE, OR TRAGE PRACTICE, ARE HEREBY EXCLUDED TO THE EXTENT ALLOWED BY APPLICABLE LAW. Transwork and/or its suppliers can be liable for damages under the general rules of contract law, refers to the provisions of the Code of Obligations which applies in the Republic of Srpska and Bosnia and Herzegovina. All above guarantees does NOT apply to any version of the portal that is used for testing or demonstration purposes, any temporary module, portal or any web portal for which Transwork who does not receive compensation for license. All those portals serve as such without any warranty. The right to use portal (license) is effective until terminated. The client may terminate the license at any time by termination of the contract and requesting to close his user account. The right of use/license will be terminated immediately without notice from Transwork, if the Client fails to comply with any provision of this Agreement. This License will be governed by and construed in accordance with the laws of the Republic of Srpska, Bosnia and Herzegovina, as if performed wholly within state and without giving effect to the principles of conflict of law. If it is determined that any part of this contract is invalid or unenforceable, the remaining provisions of this License shall remain in full force and effect. This License constitutes the entire License between the parties with respect to the use of portal.
